7.1. What personal data we collect and who has access to your data.

 

EVOARK S.R.L. collects information from its users in three ways: directly from the user, from the traffic reports recorded by the servers hosting our Websites, and through cookies.

There is a possibility that the request for personal information, such as name, address, email address, and phone number, may be necessary to improve the quality of the services offered by the site, respond to user inquiries, keep track of website usage, and handle economic and financial management, billing (refusal to provide this data makes it impossible to fulfill orders), inform Clients/Users about the progress and status of placed orders, electronic communication services (sending order confirmations, newsletters, and other periodic informational bulletins, etc.).

●        When you access the Website or when you fill out the contact form, we may ask for your name, surname, and/or email address, phone number, delivery address, personal identification number, as well as other data necessary for contracting, delivering, or billing, or for resolving requests, questions, or complaints made by you, recording information about you for the allocation or offering of rewards, discounts, and other benefits, as well as for meeting other requests or requirements you may have related to customer reward programs and other similar programs. This data is retained for a period of 3 years from the termination of the contract (this being the general prescription period) or 10 years in the case of invoices (where there is a legal fiscal obligation). If you do not provide us with this data, we will be unable to fulfill your order.

We reserve the right to record any communication made for our support services to improve our services. We will inform you before the start of the communication that it may be recorded. These data are retained for different periods but not more than 3 years from the date of the last communication with you. This period is necessary to defend against any claims that may arise regarding the issues reported by you or third parties. This data is used, for example, for contacting you, establishing the necessary data for a contract or billing, or the contact person, and/or to resolve a complaint/request from you. Non-acceptance of any modification obliges the respective user to immediately cease accessing the site.

  1. Applicable Law. Disputes

 

The clauses of this agreement are interpreted and enforced in accordance with the laws in force in Romania.

The parties agree that in the event of disagreements regarding the validity of this document or arising from its interpretation, execution, or termination, they shall be resolved amicably by their representatives.

If the parties fail to reach an amicable agreement, then, based on a written notice from either party to the other, any dispute arising from or in connection with this agreement or the use of the website will be settled through arbitration by the Court of Commercial Arbitration attached to the Chamber of Commerce and Industry of Romania in accordance with the Rules of Arbitration Procedure of this Court. The arbitral award is final and compulsory.

  1. Final Provisions

 

In the event that any of the clauses mentioned above is null or invalid, regardless of the cause of its invalidity, it will not affect the validity of the other clauses specified on the Terms and Conditions page.

Upon purchasing the Offer and concluding the service contract, the customer unconditionally accepts the Terms and Conditions of use on this page.
